What is the Community Infrastructure Levy?

The Community Infrastructure Levy (CIL) is a planning charge that allows councils to raise funds from new development. These funds are then used to pay for the infrastructure needed to support sustainable growth such as schools, health and community facilities, improvements to the transport network and parks.

Most development that results in the creation of a new home or increase in floor space by over 100 square metres is likely to be liable to pay a CIL charge.

CILs in Bexley

There are two types of CIL that apply to development within Bexley: the London Borough of Bexley CIL, which helps us support development within the borough, and the Mayor of London’s (MCIL2), which is being used to repay Elizabeth Line financing.

You might be charged one or both types of CIL, depending on your project. The CIL levy is calculated according to the amount of additional internal floorspace a new development will produce and will vary depending on which part of the borough the development site is in. Exemptions apply for example on floorspace for formal education and publicly funded medical, health and emergency services.

When is CIL charged?

A CIL information form should be submitted alongside a planning application, so that the Council can determine if the development is CIL liable. CIL is calculated at the time planning permission is granted - at this point, a liability notice will be issued confirming how much CIL is payable.

The planning applicant is responsible for payment of the CIL, unless another party assumes responsibility. 

When is CIL payable?

The levy charge is due once the development commences. If the charge meets the requirements of the MCIL instalments policy, then the borough charge could also be paid in instalments.

Before the development starts, the person who will be paying the CIL charge must send the Council the relevant forms, which can be found on the Planning Portal.
